Privacy Notice 

BGET is committed to protecting and respecting the personal data that we process. This Privacy Notice describes the policies and practices regarding the collection and use of your personal information when you apply for a British Gas Energy Trust (BGET) grant or award, when you contact us with queries or when you apply to work with us and sets out your data protection rights. 

Who are we? 

BGET, incorporating the Scottish Gas Energy Trust, is an independent charitable Trust funded solely from donations from British Gas. BGET contributes to the relief of poverty, with a particular focus on fuel poverty.

For the purposes of your application for a grant or fuel relief, when you contact us with any queries or when you apply to work with us, BGET is the Data Controller.  

What is personal data? 

Personal data is any information relating to an identified or identifiable living person. When collecting and using personal data, we are transparent about why and how we process personal data.  We process personal data for a number or purposes, and the means of collection, lawful basis of processing, use, disclosure, and retention periods for each purpose are set out in the relevant sections below. 

The personal data that is provided to us is provided either directly by you or from a third party acting on behalf of an individual.  

What is the purpose and lawful basis for processing your personal information? 

We collect personal information so we can process your application for grants or awards that BGET’s partners offer, so that we can provide advice if required and that we can process applications when you apply to work with us. 

The lawful bases we rely on for processing your personal data are:

Consent We will rely on your consent to collect and process your personal data in order to administer and award grants to help in relief of fuel poverty and to answer any requests for advice. 
Contract We rely on processing being necessary for a contract if you apply to work with us. 
Legitimate Interests We may rely on legitimate interests for some of our processing where we do not rely on consent. This could be where we undertake research or analysis of the personal data to assess the impact of the grants we award.  
Explicit Consent In accordance with the requirements of Article 9(2)(a) of the UK General Data Protection Regulation (GDPR) for ‘Special Category’ data about you (e.g. personal data such as health information or ethnicity) we will rely on your explicit consent to process any particularly sensitive personal data. 

What personal information do we collect about you and why? 

We collect personal data from you in order to process your application for grants and awards that BGET’s partners (Scheme Operators) offer, if you contact us for advice or if you apply to work with us. This data will include: 

Where personal information we collect is ‘special category’ personal data (such as health information) we will always ask for your permission to use that personal data for the purpose of processing your application or answering your queries.  

If you are providing personal data on behalf of others, we ask that you have requested and gained permission to share that personal data with us.  

What do we do with your personal information? 

Your personal data is used to assess your eligibility for grants and awards offered by BGET. We also use your personal data to respond to any queries or questions you have asked us and to manage recruitment exercises. 

We may also use your personal data to carry out research such as, for example, to understand the impact of our grants and awards and how we might be able to enhance our services. When we do this, we will either  anonymise the data we use so that you can no longer be identified or we will rely on your consent or ‘legitimate interests’ to undertake the research. 

When do we share your information? 

We will only share your personal data when we are legally permitted to do so. If we do share personal data with others we put arrangements and security mechanisms in place to protect the data and to comply with our data protection, confidentiality and security standards.  

Processors 

Like many organisations, we outsource certain data processing activities to trusted third party service providers to perform functions and provide services to us, such as ICT service providers. Where we do this, there will always be a Data Processing Contract in place.  

Our main processor is Auriga Services Limited who is BGET’s grant management service provider. Auriga Services Limited is a non-profit making company limited by guarantee registered in England No. 05093179. Do we transfer your personal information abroad? 

The personal data that we collect from you will be processed within the UK. It may be necessary, in some cases, to transfer personal data out of the UK and any such transfers will be fully compliant with the requirements of the legislation. If personal data is to be transferred outside the UK or EEA to a country which is not designated as ‘adequate’ then, if we are not relying on consent, we will ensure that appropriate safeguards are in place such as the International Data Transfer Agreement or the UK Addendum to the EU Standard Contractual Clauses to ensure that we comply with the UK GDPR. We will take all reasonable steps to ensure that your personal data is treated securely, in accordance with this privacy notice.  

How do we protect your personal information? 

We take the security of your personal data seriously. This includes requiring our service providers to use appropriate measures to protect the confidentiality and security of your data. We have put in place technical and organisational measures to prevent risks such as destruction, loss, alteration, misuse, unauthorised disclosure of, or access to your personal data. 

How long do we keep your personal information? 

We keep your personal information for the period necessary to fulfil the purposes for which it has been collected such as to complete and process your application and as required for the duration of, and for a limited time after the end of, any grant or award period.  

When your personal information is no longer required for the purposes for which we collected it, we will delete it from our systems. 

How and why we might contact you? 

We may contact you via letter, phone, email, text or post to confirm information or request further details in support of your application. We will not contact you for any purpose not directly associated with your BGET application, your query or your recruitment application. 

Your rights 

You have the following rights regarding your personal data: 

The right to be informed: You have the right to be provided with clear, transparent and easily understandable information about the processing of your personal data and which is why we’re providing you with this Privacy Notice. 

Access: You may request access to your personal data held by us as a data controller at any time. This is known as a ‘Data Subject Access Request’ (DSAR).  

Accuracy/Rectification: You can ask us to rectify or correct any inaccurate personal data that we hold.  

Erasure: You can ask us to erase your personal data and we will erase your data on request where we have no lawful reason for retaining it; 

Restrict Processing: You have the right to ask us to restrict our processing of your personal data  in certain circumstances.   

Right to Portability:  You have the right to data portability which allows individuals to obtain and reuse their personal data for their own purposes across different services. 

Object to Processing: You have the right to object where the legal basis for the processing is ‘legitimate interests’.  

Right to withdraw Consent: We rely on your consent for processing your personal data for the purpose of administering your application for a grant or award. You can withdraw your consent to this processing at any time by contacting us.

 What if you have a complaint about how we process your information? 

We hope that won’t ever need to, but if you wish to make a complaint about how we are processing your personal data in relation to your application for fuel relief then please contact Auriga Services Limited at dataprotection@aurigaservices.co.uk. If you wish to complain about how BGET is processing your personal data in connection with any queries or a recruitment application then please contact us at admin@britishgasenergytrust.org.uk and we will do our best to resolve your complaint. You also have the right to lodge a complaint with the UK data protection regulator, the Information Commissioner.
